Please read these Terms of Service and End User License Agreement ("Terms", "Agreement", or "EULA") carefully before using the LibGrow Reader application (the "Application" or "Service") operated by Wen Nuan ("Service Provider", "we", "us", or "our").

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not download, install, or use the Application.

The Service Provider grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on any compatible device that you own or control, strictly for personal, non-commercial purposes in accordance with these Terms and applicable App Store rules.

You agree not to:

• Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Application;
• Modify, adapt, translate, or create derivative works from the Application;
• Rent, lease, lend, sell, redistribute, or sublicense the Application;
• Circumvent or disable any technological protection measures, tier limits, or usage restrictions in the Application.

The Application offers optional auto-renewing subscription plans and in-app purchases ("Premium" or "Pro" tiers) that unlock advanced features such as expanded AI credits, increased cloud sync capacity, and enhanced reading utilities.

• Billing: Payment will be charged to your Apple ID / App Store account (or other relevant platform account) at the confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• Managing & Cancelling Subscriptions: You can manage or cancel your subscriptions at any time through your Apple ID Account Settings (or App Store Subscriptions menu). Cancellation takes effect at the end of the current paid billing cycle.
• Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication or tier, where applicable.
• Refunds: All payments made through the Apple App Store are processed directly by Apple and are subject to Apple's refund policies. You may request refunds directly from Apple Customer Support.

The Application provides features powered by Artificial Intelligence (AI) and machine learning, including word definitions, bilingual translations, syntax breakdowns, and sentence analysis.

• AI features are provided as educational and reading assistance tools on an "as-is" and "as-available" basis.
• AI-generated text, analyses, and translations may occasionally contain inaccuracies, omissions, or errors. The Service Provider does not guarantee the absolute accuracy, completeness, or appropriateness of any AI-generated output.
• You agree to use AI-generated insights at your own discretion.

The Application allows you to import reading materials (such as EPUB books, web clippings, and text files) and create user-generated content (including highlights, notes, and reading progress).

• Ownership: You retain full ownership of the notes, annotations, and content you import or create.
• User Responsibility: You are solely responsible for ensuring that any materials you import into the Application comply with all applicable copyright and intellectual property laws. You agree not to use the Application to import, store, or distribute materials that infringe on any third-party rights.
• Public Domain Integration: Public library integrations (such as Project Gutenberg and Aozora Bunko) provide access to works believed to be in the public domain. You are responsible for verifying the copyright status of any work in your specific jurisdiction.

Certain features (such as multi-device cloud synchronization) may require creating an account or signing in (e.g., via Sign in with Apple or Email). You are responsible for safeguarding your login credentials and for all activities that occur under your account. The Service Provider reserves the right to suspend or terminate accounts that violate these Terms.

The Application, including its original source code, user interface, brand assets, logos, and design, is the exclusive intellectual property of Wen Nuan and is protected by international copyright, trademark, and other intellectual property laws.

THE APPLICATION AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE PROVIDER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APPLICATION. IN NO CASE SHALL THE TOTAL LIABILITY OF THE SERVICE PROVIDER EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

If you downloaded the Application from the Apple App Store, the following terms apply:

• Acknowledgement: You acknowledge that this Agreement is concluded between you and the Service Provider only, and not with Apple Inc. ("Apple"). The Service Provider, not Apple, is solely responsible for the Application and its content.
• Maintenance and Support: The Service Provider is solely responsible for providing any maintenance and support services with respect to the Application. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
• Product Claims: The Service Provider, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of that Application.
• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Tokyo, Japan, and the parties hereby consent to personal jurisdiction and venue therein.

The Service Provider reserves the right to modify or replace these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Application following any changes constitutes acceptance of the new Terms.
